How to estimate Brazilian domestic termination

Enter the fixed monthly salary, actual month length, unpaid days, reason and notice mode. Then enter confirmed twelfths and acquired vacation days from the employment record. With BRL 2,000, a 30-day month, 15 unpaid days, one completed year, payment in lieu and six twelfths each of 13th salary and vacation, the estimate is BRL 5,533.33 gross.

Resignation, dismissal and notice

Dismissal without cause can include payment in lieu for 30 days plus three per completed year, capped at 90. On resignation, retain confirmed proportional vacation and 13th salary and enter any notice deduction of up to 30 days. Dismissal for cause excludes notice, 13th salary and proportional vacation in this estimate; confirmed acquired vacation remains.

Vacation, 13th salary and notice projection

13th salary uses calendar-year twelfths and proportional vacation uses twelfths in the incomplete acquisition period. Simple and doubled vacation use unpaid, unused acquired days with no overlap. The one-third addition applies to their combined principals. Notice projection must already be included in confirmed twelfths; no further twelfths are added.

The Brazilian domestic 3.2% reserve and FGTS

LC 150 provides a domestic compensatory reserve distinct from ordinary FGTS deposits. For supported reasons, the reserve belongs to the worker on dismissal without cause and to the employer on resignation or dismissal for cause. Enter only its statement balance; it is shown separately and receives no additional 40% fine.

Frequently asked questions

Is this the net amount?

No. The balance is only gross credits minus any notice deduction. INSS, IRRF, advances, separate DSR and other adjustments are not calculated.

Does Brazilian domestic termination have a 40% FGTS fine?

This domestic estimate applies neither the general 40% fine nor the 20% fine. LC 150 provides a separate 3.2% compensatory reserve, distinct from ordinary FGTS and direct payment.

Who receives the 3.2% reserve?

For supported reasons, the worker is the indicated owner on dismissal without cause; the employer is indicated on resignation or dismissal for cause. The balance comes from the supplied statement and movement must be confirmed; withdrawal is not promised.

Does resignation include proportional vacation and 13th salary?

Yes. This simulation retains confirmed vacation and 13th-salary twelfths on resignation. Unserved notice may be deducted, with its days supplied separately by the user.

How do I include notice in the twelfths?

Enter twelfths already confirmed with the applicable projection. No twelfths are added automatically. For 13th salary, at least 15 days of work count as a month. Calendar-year transitions and completed vacation periods need reconciliation in eSocial.

Can I calculate part-time, probation or mutual-agreement cases?

These cases are outside this version. It covers fixed monthly pay, indefinite contracts and the standard 30-day annual vacation entitlement for the three offered reasons. Check other cases in eSocial or with a professional.

Why does salary balance use calendar-month days?

The domestic manual’s eSocial3000 rubric uses the actual number of days in the month as divisor. Thus BRL 3,100 for 15 days in a 31-day month gives BRL 1,500. Notice and acquired vacation days use divisor 30.
