Brazil CLT Severance Calculator

Estimate Brazilian CLT severance pay, notice, vacation, 13th salary, FGTS and deductions with a transparent calculation memo.

How to calculate Brazilian CLT severance

A CLT severance estimate starts with base remuneration, formed by monthly salary and habitual variable averages entered by the user.

The calculator estimates salary balance, notice, 13th salary, vacation plus one-third, FGTS, fine and deductions, separating each item for review.

What enters dismissal without cause

In dismissal without cause, the estimate includes the main items normally reviewed in a Brazilian TRCT.

  • Salary balance for the exit month.
  • Worked or indemnified notice, with proportional days by service time.
  • Proportional 13th salary and overdue or proportional vacation plus one-third.
  • 40% FGTS fine and displayed eligible FGTS withdrawal.

Resignation vs dismissal without cause

Resignation

Resignation keeps salary balance, 13th salary and vacation, but this simulator does not show an FGTS fine or immediate withdrawal. Notice may be worked, waived or deducted.

Dismissal without cause

Dismissal without cause may include indemnified notice, FGTS fine and withdrawal of the eligible balance, besides proportional items.

Worked, indemnified and deducted notice

Proportional notice starts at 30 days and adds 3 days per full year of service, capped at 90 days.

When notice is indemnified, projection may affect 13th salary and vacation avos. On resignation, this calculator deducts 30 days only when selected.

How vacation, 13th salary and FGTS are estimated

The 13th salary counts months in the termination year with at least 15 contract days. Proportional vacation counts the current acquisition period and is capped at 11/12.

Termination FGTS is estimated at 8% over selected remuneratory items. If no FGTS balance is entered, the historical base is approximated from current remuneration.

Calculator limits and when to seek help

This simulation does not replace TRCT, eSocial, FGTS Digital, accountant, union or lawyer review. Collective agreements, stability, leaves, absences, variable averages and prior payments can change results.

Domestic workers, apprentices, temporary contracts, probation contracts, public servants and complex judicial cases are outside this first scope.

FGTS, net salary, vacation, 13th salary, unemployment insurance and specific severance scenarios are also in the backlog.

This calculator provides an educational estimate, not legal, tax or payroll advice. Official TRCT, eSocial, FGTS Digital and professional review prevail.

Frequently asked questions

Does the calculator show the exact net amount?
No. It estimates items and deductions from the typed inputs. The official amount depends on payroll, TRCT, eSocial, FGTS Digital, collective agreement and professional review.
How do I calculate dismissal without cause?
It usually includes salary balance, notice, proportional 13th salary, vacation plus one-third, 40% FGTS fine and eligible FGTS withdrawal. The calculator separates each item.
Does resignation receive an FGTS fine?
In this simulator, resignation does not generate an FGTS termination fine or immediate withdrawal. Salary balance, 13th salary and vacation may still exist.
How much FGTS applies to mutual agreement?
Mutual agreement estimates a 20% fine over the FGTS base and displays withdrawal of up to 80% of the eligible balance.
Does proportional notice count in the calculation?
When indemnified, proportional notice enters as a credit and may project 13th salary and vacation avos. When worked, the termination date should already reflect the last worked day.
Do overdue vacations enter even with cause?
Yes, the calculator keeps overdue vacation plus one-third when you enter overdue periods, but removes proportional vacation and proportional 13th salary in dismissal with cause.
What changes with variable pay, overtime or commissions?
Enter the habitual monthly average in the variable remuneration field. It increases the base used for salary, notice, vacation, 13th salary and related estimates.
